  1. Any member of the public may address the Board: 1) on any agenda item before or during the Board's consideration of the item; 2) on any matter not on the agenda that is within the subject matter jurisdiction of the Board at the time provided on the agenda for public comment, provided the person submits a completed Registration Card to Address the Board form to the Clerk of the Board or his/her designee prior to the time the Chairperson calls the item for the Boards consideration.  This is not meant to be a debating period.  Complaints and problems relating to policy matters will be referred to the Superintendent.

The person wishing to address the Board shall, when recognized by the Chairperson of the Board, step up to the rostrum and announce his/her name and address.  The Chairperson shall, in the interest of facilitating the business of the Board, limit the amount of time which a member of the public may use in addressing the Board to five minutes, unless the Chairperson, or a majority of the Board determines that a different limit is appropriate.

The Board of Education receives its agenda, and other pertinent information, on the Friday prior to the meeting.  The Board, therefore, has had an opportunity to review all this material over the weekend prior to taking action.

1. Budget Reduction Process - Information.

a. Members of the Board MAY give the Superintendent direction to support/oppose legislation currently under consideration in Sacramento and/or Washington, D.C. Comment on or discussion of a particular bill and/or resolution may precede any direction given the Superintendent. Board members may direct the Superintendent to communicate an urgent action on ANY other bill or other consideration, currently before the Legislature or Congress, not listed on the Agenda IF the item came to the attention of a Board member[s] or staff member[s] after the posting of the Agenda and if two-thirds [four votes] of the Board agree to the addition to the Agenda [Government Code Section 54954.2].

b. Approve agreement for consultant services with Dolinka Group, LLC, to conduct an in-depth study of redevelopment project areas within the Redlands Unified School District, effective November 18, 2009, cost to be based on the included fee schedule, not to exceed $33,000.00, to be funded by Redevelopment Agency Funds. Authorize Sherryl Avitabile, Assistant Superintendent, Business Services, to sign related documents on behalf of the Board (Appendix Item).         (C)  
 

 

Dolinka Group are experts in the Redevelopment area. The District contracted with Dolinka in January 2009 to conduct Phases I and II of a study of existing Redevelopment Agency Areas (RDAs) within RUSD boundaries due to the changes in the area of RDA law, amendments to existing and new RDA projects. This agreement allows them to proceed with Phase III, to resolve current RDA pass-through discrepancies.

         
c. Approve agreement with Environmental Vehicle Services, to provide oversight of Phase 2 of the Compressed Natural Gas Station, at a cost not to exceed $11,545.00, effective November 18, 2009 through November 18, 2010, to be funded by Transportation Grant Funds (Appendix Item).         (C)  
 

 

On January 15, 2008 the Board approved an agreement with the South Coast Air Quality Management District (AQMD) to provide $525,000 or 75% of the total project cost to the District to install a new, time-fill CNG (Compressed Natural Gas) fueling facility. Leland Burke of Environmental Vehicle Services was the consultant on Phase 1 of the Compressed Natural Gas Station Project and is familiar with the facility and the requirements of the AQMD Grant.

         
d. Approve agreement with PCH Architects, LLP, for Architectural Services for the modernization of Mission Elementary School, effective November 18, 2009, to be funded by State and Local Construction Funds. Authorize Sherryl Avitabile, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).         (C)  
 

 

The District issued a Request for Proposal for Architectural Services for the modernization of Mission Elementary School. The Mission School Architectural Services Selection Committee selected PCH Architects, LLP, based on their experience working on previous projects with Redlands Unified School District and their location and accessibility to the project. PCH has worked with the District for over 21 years and has a long standing track record for delivering projects on-time and within budget.

         
e. Ratify/Approve Agreement for Use of Facilities with the Redlands Swim Team (RST) to use pools at Redlands East Valley High School and Redlands High School. The annual fee for RST to use the facilities are $45,000 for the 2009-10 school year, $50,000 for the 2010-11 school year, and $55,000 for the 2011-12 school year (Appendix Item).         (C)  
 

 

Redlands Swim Team (RST), a non-profit 501C3 corporation has used the high school pools for their practices and swim meets for years. RST previously paid $8,950 during the 2008-09 School Year. This new agreement caps the usage to 3,500 hours per year and brings the amount charged more in line with the expenses incurred for such usage and incrementally raises the fees to actual costs incurred.

         
f. Ratify/Approve Memorandum of Understanding with Valley Star Child and Family Services to implement the Student Assistance Program (SAP) and NCTI-Crossroads Program at Bryn Mawr and Mentone Elementary Schools. This agreement will be effective October 1, 2009 through June 30, 2010, at no cost to the District (Appendix Item).         (C)  
 

 

Implementation of the Student Assistance Program includes the award-winning Second Step violence prevention program with classroom-based training in such areas as social skills, anger management, communications skills, problem-solving and peer interaction. This is the second year that Valley Star Child and Family Services has provided this program at Bryn Mawr and Mentone Elementary Schools.

         
g. Accept the San Bernardino County Superintendent of Schools staff report of the visit to Lugonia Elementary School to ensure their compliance with the Williams Legislation (Appendix Item).         (C)  
 

 

Per Education Code Section 1240, San Bernardino County Superintendent of Schools staff visit schools ranked in deciles 1 to 3 based to ensure their compliance with the Williams Legislation. The results of the visit shall be reported to the Governing Board.

         
h. Approve Change Orders for Citrus Valley High School, Bid No. 5-08, in the amount of $101,908.21 to be funded by State and Local School Construction Funds. Authorize Brian Hardy, Coordinator, Facilities Planning Services, to sign on behalf of the Board (Appendix Item).         (C)  
 

 

These change orders are for Phase II for the Citrus Valley High School Project which the Board awarded on April 15, 2008. Each change order contains an explanation of the reason for the changes, the amount, the addition of days in the contract, if any, and the amended contract amount.

         
i. Approve Change Orders for Citrus Valley High School, Bid No. 5-07, in the amount of ($38.11), to be credited to State and Local School Construction Funds. Authorize Brian Hardy, Coordinator, Facilities Planning Services, to sign on behalf of the Board (Appendix Item).         (C)  
 

 

This series of change orders is for Phase I of the Citrus Valley High School Project which the Board awarded on May 22, 2007. Each change order contains an explanation of the reason for the change order, the amount, the addition of days in the contract, if any, and the amended contract amount.

         
j. Accept as complete and approve filing Notices of Completion with the County Hall of Records for Bid 5-07/Category 17 – Cool Air Supply, Inc. and Category 22 – Kitcor Corporation for the construction of Citrus Valley High School. Authorize Sherryl Avitabile, Assistant Superintendent, Business Services, to sign on behalf of the Board.         (C)  
 

 

On May 22, 2007 the Board awarded Bid 5-07 for the construction of the first phase of CVHS. Authorized District staff has verified that the work for these two categories has been completed as of August 1, 2009.

         
k. Authorize release of fifty percent (50%) retention, pursuant to Public Contract Code Section 9203, to Nibbelink Masonry Construction Corp. for Bid 5-08, at Citrus Valley High School, finding that satisfactory progress is being made by the contractor to date. The District shall maintain the remaining fifty percent (50%) retention, or five percent (5%) of the contract amount, until project completion and final acceptance in accordance with the Public Contract Code.         (C)  
 

 

Public Contract Code Section 9203 provides that the Governing Board, at its discretion, may approve the release of fifty percent of the retention held by the District (the District retains 10%), if it finds that satisfactory progress is being made. Nibbelink Masonry Construction Corp. has requested a retention reduction on the Citrus Valley High School Project, Phase II. Based on the performance of this contractor, District staff recommends that the request be granted as provided for by Public Contract Code.

         
l. Approve Payment Batches 0967 through 1192 for November 17, 2009, in the amount of $4,616,294.95. Authorize Sherryl Avitabile, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).         (C)

In accordance with E.C. 52853(f), 54004.1(b), 54726(j), and 54734(e), all Single Plans for Student Achievement must be approved by the local Governing Board on an annual basis.

Unfold XIV.  EDUCATIONAL SERVICES ACTION ITEMS   
         
a. Approve Waiver Request – Administering the Physical Fitness Test outside the February to May test window with the California Department of Education to begin October 1 and end May 31, each year, pursuant to Education Code 33050-33053 (Appendix Item).         (V)  
 

 

Redlands Unified School District is requesting to have the “annual assessment window” for the Physical Fitness Test to begin October 1 and end on May 31 of each school year. Redlands Unified School District employs five (5) Physical Education Specialists that travel between 15 elementary sites. Their primary goal is to prepare students to take the Physical Fitness Test. They are also responsible for administering the Physical Fitness Test. This setup necessitates that the Physical Fitness Testing window begin in October and end in May.

         
b. Approve the Expulsion regarding student 2009-2010-016, expulsion through the balance of the 2009-2010 school year, with said expulsion suspended.         (V)  
 

 

Student 2009-2010-016 was recommended for expulsion in violation of Education Code 48900(m) Possession of an imitation firearm (soft air gun).

         
c. Approve the Stipulated Expulsion Agreement regarding student 2009-2010-019, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-019 was recommended for expulsion in violation of Education Code 48900 (a)-1 Caused, attempted to cause, threatened to cause physical injury to another person; Education Code 48900(k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, school officials, or other school personnel engaged in the performance of their duties; and Education Code 48915(a)-5 Assault or battery, as defined in Sections 240 and 242 of the Penal Code, upon a school employee.

         
d. Approve the Expulsion regarding student 2009-2010-020, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-020 was recommended for expulsion in violation of Education Code 48900 (i) Committed an obscene act or engaged in habitual profanity or vulgarity; and Education Code 48915 (a)-5 Assault or battery, as defined in Sections 240 and 242 of the Penal Code, upon a school employee.

         
e. Aprove the Expulsion regarding student 2009-2010-021, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-021 was recommended for expulsion in violation of Education Code 48900 (a)-1 Caused, attempted to cause, threatened to cause physical injury to another person; and Education Code 48900 (k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, school officials, or other school personnel engaged in the performance of their duties.

         
f. Approve the Expulsion regarding student 2009-2010-022, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-022 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance; and Education Code 48900 (h) Possessed or used tobacco, or any products containing tobacco or nicotine products.

         
g. Approve the Expulsion regarding student 2009-2010-023, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-023 was recommended for expulsion in violation of Education Code 48900 (j) Unlawfully possessed, or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code.

         
h. Approve the Stipulated Expulsion Agreement regarding student 2009-2010-024, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-024 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (Ecstasy).

         
i. Approve the Stipulated Expulsion Agreement regarding student 2009-2010-025, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-025 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana and Methadone); and Education Code 48900 (j) Unlawfully possessed, or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code.

         
j. Approve the Stipulated Expulsion Agreement regarding student 2009-2010-026, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-026 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (Methadone).

         
k. Approve the Stipulated Expulsion Agreement regarding student 2009-2010-027, expulsion through the balance of the 2009-2010 school year.         (V)  
 

 

Student 2009-2010-027 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana).

Student 2009-2010-030 was recommended for expulsion in violation of Eduction Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (Ecstasy).

Student 2009-2010-033 was recommended for expulsion in violation of Education Code 48900 (i) Committed an obscene act or engaged in habitual profanity or vulgarity; Education Code 48900 (k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, school officials, or other school personnel engaged in the performance of their duties; and Education Code 48900.4 Intentionally engaged in harassment, threats, or intimidation against a pupil or group of pupils.

a. Certificated - Adopt Resolution No. 25, 2009-2010: Approve employment of certificated personnel, effective the 2009-2010 school year, based on approval by the California Commission on Teacher Credentialing of a waiver for EC 44256(b) credential requirements (Appendix Item).         (V)  
 

 

Effective November 1, 1995, every request for a waiver of credential requirements submitted to the Commission on Teacher Credentialing must include verification that a notice of intent to employ the named applicant in the identified position has been made public.

         
b. Certificated - Adopt Resolution No. 26, 2009-2010: Approve employment of certificated personnel, effective the 2009-2010 school year, based on approval by the California Commission on Teacher Credentialing of a waiver for EC 44263 credential requirements (Appendix Item).         (V)  
 

 

Effective November 1, 1995, every request for a waiver of credential requirements submitted to the Commission on Teacher Credentialing must include verification that a notice of intent to employ the named applicant in the identified position has been made public.

e. Management - Approve payment to Vincent Christakos for 27.28 days of unused vacation time at $558.62 per day, for a total of $15,239.15.         (V)  
 

 

In accordance with Labor Law, employees are entitled to the payoff of any unused vacation balance upon termination of their employment. Due to the resignation of Vincent Christakos as the Assistant Superintendent, Business Services, he was entitled to the payoff of 27.28 days (218.25 hours), including a carryover balance of 20.37 days unused vacation earnings from prior years, as well as an accrual of 6.91 days earned between July 1, 2009 and October 22, 2009.
