a. COMMUNITY INPUT         
  1. Any member of the public may address the Board: 1) on any agenda item before or during the Board's consideration of the item; 2) on any matter not on the agenda that is within the subject matter jurisdiction of the Board at the time provided on the agenda for public comment, provided the person submits a completed Registration Card to Address the Board form to the Clerk of the Board or his/her designee prior to the time the Chairperson calls the item for the Boards consideration.  This is not meant to be a debating period. Complaints and problems relating to policy matters will be referred to the Superintendent.

The person wishing to address the Board shall, when recognized by the Chairperson of the Board, step up to the rostrum and announce his/her name and address.  The Chairperson shall, in the interest of facilitating the business of the Board, limit the amount of time which a member of the public may use in addressing the Board to five minutes, unless the Chairperson, or a majority of the Board determines that a different limit is appropriate.

The Board of Education receives its agenda, and other pertinent information, on the Friday prior to the meeting.  The Board, therefore, has had an opportunity to review all this material over the weekend prior to taking action.

a. Members of the Board MAY give the Superintendent direction to support/oppose legislation currently under consideration in Sacramento and/or Washington, D.C. Comment on or discussion of a particular bill and/or resolution may precede any direction given the Superintendent. Board members may direct the Superintendent to communicate an urgent action on ANY other bill or other consideration, currently before the Legislature or Congress, not listed on the Agenda IF the item came to the attention of a Board member[s] or staff member[s] after the posting of the Agenda and if two-thirds [four votes] of the Board agree to the addition to the Agenda [Government Code Section 54954.2].

Ratify/Approve Amendment No. 2 to the Crossing Guard Services Agreement with the City of San Bernardino, to provide crossing guard services to Victoria Elementary School, at a cost not to exceed $5,150, effective July 1, 2009 through June 30, 2010, to be funded by Risk Management Funds (Appendix Item).         (C)  
 

 

The City of San Bernardino and the Redlands Unified School District will equally share the cost of the crossing guard services.

         
c. Approve Sherryl Avitabile, Assistant Superintendent, Business Services, as the Custodian of the Revolving Cash Fund as established on County Form No. 6 (Appendix Item).         (C)  
 

 

County Form No. 6 establishes Sherryl Avitabile, Assistant Superintendent, Business Services, as the Custodian of the Revolving Cash Fund.

         
d. Approve Brian Guggisberg, Director, Fiscal Services, as an authorized agent for documents, contracts and certification of Board action on behalf of the Governing Board (Appendix Item).         (C)  
 

 

The San Bernardino County Superintendent of Schools, District Financial Services Division, County Form Numbers 1, 2, and 2c approves authorized agent status for the District.

         
e. Approve Change Order 29-19CB-5, with R.I.S. Electrical Contractors, Inc. for Citrus Valley High School, Bid No. 5-08, in the amount of $83,637.00 to be funded by State and Local School Construction Funds. Authorize Brian Hardy, Coordinator, Facilities Planning Services to sign on behalf of the Board (Appendix Item).         (C)  
 

 

This change order is for Phase II of the Citrus Valley High School Project which the Board awarded on April 15, 2008. The change order contains an explanation of the reason for the changes, the amount, the addition of days in the contract, if any, and the amended contract amount.

         
f. Authorize release of fifty percent (50%) retention, pursuant to Public Contract Code Section 9203, to J.G. Tate Fire Protection Systems, Inc. for Bid 5-08, at Citrus Valley High School, finding that satisfactory progress is being made by the contractor to date. The District shall maintain the remaining fifty percent (50%) retention, or five percent (5%) of the contract amount, until project completion and final acceptance in accordance with the Public Contract Code.         (C)  
 

 

Public Contract Code Section 9203 provides that the Governing Board, at its discretion, may approve the release of fifty percent of the retention held by the District (the District retains 10%), if it finds that satisfactory progress is being made. J.G. Tate Fire Protection Systems, Inc. has requested a retention reduction on the Citrus Valley High School Project, Phase II. Based on the performance of this contractor, District staff recommends that the request be granted as provided for by Public Contract Code.

         
g. Approve Payment Batches 1631 through 1752 for January 26, 2010, in the amount of $2,695,455.04. Authorize Sherryl Avitabile, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).         (C)  
         
h. Accept donations. Instruct secretary to write letters of appreciation on behalf of the Board (Appendix Item).         (C)

In accordance with Education Codes 52853(f), 54004.1(b), 54726(j), and 54734(e), all Single Plans for Student Achievement must be approved by the local Governing Board on an annual basis.

         
c. Approve 12 students from the Redlands East Valley High School Winter Guard group to travel, by car, to Phoenix, Arizona, to participate in the Regional Winter Guard Competition, effective March 12, 2010 through March 14, 2010.         (C)

d. Approve 21 students from the Redlands High School Thespian Class to travel, by bus, to the Ontario Convention Center, to attend the Annual State Thespian Festival, effective March 26, 2010 through March 28, 2010.         (C)  
 

 

To be funded by ASB – Drama – Thespians (During Spring Break - Zero days of school missed). Justification for spending two nights in Ontario: late-night activities and early morning rehearsals. Hotel stay is more cost effective than transportation back and forth each day.

a. Deny request for readmission of student 2007-2008-049, following expulsion effective September 23, 2008.         (V)  
 

 

Student 2007-2008-049 was recommended for expulsion in violation of Education Code 48915 (c)-2 Brandishing a knife at another person. The student did not meet the terms and conditions of his/her rehabilitation plan; therefore, it is recommended that student 2007-2008-049 return to Community Day School for the second semester of the 2009-2010 school year.

         
b. Deny request for readmission of student 2009-2010-015, following expulsion effective October 27, 2009.         (V)  
 

 

Student 2009-2010-015 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana). The student did not meet the terms and conditions of his/her rehabilitation plan; therefore, it is recommended that student 2009-2010-015 return to Community Day School for the second semester of the 2009-2010 school year.

         
c. Approve request for readmission of student 2008-2009-028, following expulsion effective February 10, 2009, through the balance of the 2008-2009 school year; and the first semester of the 2009-2010 school year.         (V)  
 

 

Student 2008-2009-028 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana). The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

         
d. Approve request for readmission of student 2008-2009-030, following expulsion effective February 24, 2009, through the balance of the 2008-2009 school year; and the first semester of the 2009-2010 school year.         (V)  
 

 

Student 2008-2009-030 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana); and Education Code 48900 (j) Unlawfully possessed, or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia as defined in Section 11014.5 of the Health and Safety Code. The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

         
e. Approve request for readmission of student 2008-2009-034, following expulsion effective March 10, 2009, through the balance of the 2008-2009 school year; and the first semester of the 2009-2010 school year.         (V)  
 

 

Student 2008-2009-034 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (marijuana); and Education Code 48900 (j) Unlawfully possessed, or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code. The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

Student 2008-2009-036 was recommended for expulsion in violation of Education Code 48900 (g) Stole or attempted to steal school property or private property. The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

         
g. Approve request for readmission of student 2008-2009-044, following expulsion effective March 24, 2009, through the balance of the 2008-2009 school year; and the first semester of the 2009-2010 school year.         (V)  
 

 

Student 2008-2009-044 was recommended for expulsion in violation of Education Code 48900 (j) Unlawfully possessed, or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code. The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

         
l. Approve request for readmission of student 2008-2009-075, following expulsion effective June 23, 2009, through the balance of the 2009-2010 school year; with the second semester of the 2009-2010 school year suspended.         (V)  
 

 

Student 2008-2009-075 was recommended for expulsion in violation of Education Code 48900 (c) Unlawfully possessed, used, sold or otherwise furnished, or been under the influence of any controlled substance (alcohol). The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

         
m. Approve request for readmission of student 2009-2010-014, following expulsion effective October 27, 2009, through the balance of the 2009-2010 school year; with the second semester of the 2009-2010 school year suspended.         (V)  
 

 

Student 2009-2010-014 was recommended for expulsion in violation of Education Code 48900 (k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, school officials, or other school personnel engaged in the performance of their duties. The student has met all conditions of the expulsion order and is eligible for readmission for the second semester of the 2009-2010 school year.

Effective November 1, 1995, every request for a waiver of credential requirements submitted to the Commission on Teacher Credentialing must include verification that a notice of intent to employ the named applicant in the identified position has been made public.
